Terms of Service

These Terms of Service ("Terms") govern your use of the SmartMode AI platform operated by Dub2AI LLC. By accessing or using SmartMode AI, you agree to these Terms.

1. Service Description

SmartMode AI is the AI digital workforce platform for small and medium businesses. It provides AI Digital Workers across nine departments — Voice, Chat, Sales, Marketing, Social Media, Research, Operations, Finance & Accounting, and HR — delivered as a subscription service.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Subscription and Payment

SmartMode AI is offered on a monthly or annual subscription basis with modular per-department pricing. Payment is due on the first day of each billing cycle. Annual subscribers receive a 25% discount, paid upfront. You may cancel at any time; cancellation takes effect at the end of the current billing period.

4. Acceptable Use

You agree to use SmartMode AI for lawful business purposes only. You may not use the platform to: violate any applicable laws or regulations; send spam or unsolicited communications; process or store data in violation of privacy laws; attempt to reverse engineer or compromise the platform; or resell the service without authorization.

5. Data Ownership

You own your data. SmartMode AI does not claim ownership of any content, data, or information you upload or generate through the platform. We use your data solely to provide the service. See our Privacy Policy for details.

6. Service Level

SmartMode AI targets 99.9% uptime availability. Planned maintenance windows are communicated in advance. We make commercially reasonable efforts to maintain service continuity.

7. Limitation of Liability

SmartMode AI is provided "as is." We are not liable for indirect, incidental, special, or consequential damages. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

8. Termination

Either party may terminate by providing written notice. Upon termination, your data is retained for 30 days before permanent deletion. We may terminate immediately for violations of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Harris County, Texas.
